Mark Thomas


Mark is a Director in our Litigation and Dispute Resolution department and has been tasked with facilitating the establishment of the Andersen in South Africa Intellectual Property service offering.

Mark advises on commercial and regulatory disputes, focusing on obtaining strategic outcomes. He has advised clients in mediation, arbitration, before all tiers of the Superior Courts, and a number of specialist tribunals in matters related to company law, environmental law, competition law, insolvency law, intellectual property law, and mining law.

Litigation and Dispute Resolution:

  • Assisting the largest independent creditor of a large South African mining concern (in business rescue) to protect its interests in the business rescue process
  • Advising a developer of high-end residential properties in review proceedings before the High Court, Supreme Court of Appeal and Constitutional Court
  • Advising one of the largest iron ore producers in South Africa in a number of urgent High Court applications to protect its mineral deposit
  • Representing a listed chemical company in a contractual interpretation and environmental liability arbitration
  • Representing members of a royal family in corporate membership and mining and ownership disputes

Competition Law:

  • In separate unrelated investigations by the Competition Commission of South Africa, advising a diamond mining company, an electronic equipment company, a heavy machinery distributor and a battery distributor in investigations of alleged anti-competitive conduct
  • In separate unrelated complaints, representing original equipment manufacturers in complaint referrals to and before the Competition Tribunal
  • In separate unrelated mergers and acquisitions, representing foreign firms obtain merger clearance from the South African Competition Authorities in relation to coal, vanadium, and iron ore interests
  • Providing tailored and strategic competition law advice and training to company boards, industry bodies, and trade associations

Intellectual Property Law:

  • Representing a wholly owned subsidiary of a listed company in protection of confidential information and alleged trademark infringement in the High Court and in arbitration
  • In separate disputes, advising two different publishing houses in relation to unauthorised use and production of musical works
  • Instituting urgent legal proceedings to protect confidential and proprietary information, obtaining search and seizure orders
